The United States Patent and Trademark Office (USPTO) announced extensions to the time allowed to file certain patent and trademark-related documents and to pay certain required fees. These actions are an exercise of temporary authority provided to the USPTO by the Coronavirus Aid, Relief, and Economic Security Act (CARES Act) signed by President Trump on March 27.
Extensions may be given for certain actions filed with the USPTO having due dates between March 27 and April 30. An extension would require a certification that the delay in filing was materially impacted by COVID-19.
In addition to the relief announced today, the USPTO previously announced that it will be suspending the fee for petitions to revive when an application is abandoned happened due to a failure to act caused by COVID-19.
