Patent applications involving mechanical devices and medical devices with mechanical “moving parts” have generally been “safe” from patent eligibility “101” rejections, at least in comparison to computer and software-based applications. However, we have observed recent cases where these mechanical devices are rejected as patent-ineligible, therefore, learning ways to avoid these rejections is imperative.
